NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE, PAYMENT, OR DONATION WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHEREVER PROHIBITED BY LAW.

Eligibility: This Sweepstakes (“Mindful Miles Sweepstakes #3”) is open to those who are 18 years of age or older as of the date of entry. The Sweepstakes is only open to legal residents of the United States of America (“USA”) and is void where prohibited by law. Employees of Mindful Miles, Mola Media LLC, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

Agreement to Rules: By participating, the Contestant (“You”) agrees to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Mola Media LLC as final and binding as it relates to the content of this Sweepstakes.

Sweepstakes Period: The Sweepstakes begins at 12:00:01 a.m. MST on March 10, 2025 and ends at 11:59:59 p.m. MST on April 30, 2025 (“Sweepstakes Period”).

PRIZE: The prize consists of two (2) $1,500 flight vouchers (only applicable for round trip flights originating from the United States and landing in Japan), one (1) $1000 lodging voucher (Only applicable for lodging expenses in Japan), and $1,000 cash award/check (“Prize” or “Grand Prize”). 

The Prize package has an approximate retail value (“ARV”) of $5,000. Vouchers and or Prize have an expiry of two (2) months from the received notification date.

NOTE #1: The Grand Prize Winner understands and agrees that the Prize ceremony be videotaped/photographed. Rights to any Prize ceremony video/photo belong solely to the Sponsor and can be used in any media at their sole discretion.

The value of the Prize set forth above represents Sponsor’s good faith determinations of the ARV thereof and such determinations are final and binding and cannot be appealed. If the actual value of the Prize is lower than the stated ARV when the Prize is procured and fulfilled, then the difference will not be awarded. All other expenses associated with Prize acceptance or usage not specifically mentioned herein are the responsibility of the Winner. All other costs not specifically stated herein as being awarded are the responsibility of the Winner. No substitution or transfer of the Prize will be permitted, except by the Sponsor, who reserves the right at its sole discretion to substitute the Prize with another prize of equal or greater value.

HOW TO ENTER:

Two (2) methods of entry as follows:

1. Online Purchase – During the Sweepstakes Period, can enter the Sweepstakes at https://www.mindfulmiles.co/ (the “Website”). At the Website, Entrants can obtain entries based on their purchase. Each product will have an assigned amount of entries.

2. Via Mail - During the Sweepstakes Period, Entrants can obtain Sweepstakes entries by legible hand-printing, on a 3”x 5” card or paper, their full name, complete mailing address, phone number, date of birth, email address, and a brief description (at least 25 words) on what winning the Grand Prize would mean to you, mailing the card in a #10 business-sized envelope, with proper postage affixed, to: Mindful Miles Sweepstakes #3, 4 Polo Drive, Colorado Springs, CO 80906 (the “Mail-In Entry”). All mail-in entries must be received by April 30, 2025. Each mail-in entry received will be worth fifteen (15) Sweepstakes entries. If a mail-in entry is postmarked during a Bonus Entry Period, it will be worth between thirty (30) and ninety (90) Sweepstakes entries depending on the level of Bonus Period defined by Sponsor at the Website. In order for bonus entries to be valid, the Entrant must write the Bonus Entry Period (example, 2X or 6X) on the backside of the envelope to signify what Bonus Entry Period they are entering during. If an Entrant lists a Bonus Period that is inaccurate with the postmark date, the entry will be disqualified. **NOTE: Mail-in entry card and envelope must be hand-printed by the Entrant only. In addition, Entrants are not permitted to use any 3rd party organization to assist with the entry process in any way (as determined by the Administrator). Each Envelope must be mailed individually. Bulk shipments of entries will not be accepted.

The Released Parties are not responsible for late, incomplete, delayed, undelivered, or misdirected entries. All entries become the exclusive property of Sponsor and will not be acknowledged or returned except as provided herein. All information submitted by Entrants will be treated according to Sponsor’s Privacy Policy, available at https://www.mindfulmiles.co/privacy-policy. By participating in the Sweepstakes and providing any personal contact information, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.

Throughout the Sweepstakes Period, the Sponsor may announce Bonus Entries at the Website, and/or on its social media pages, opportunities to earn additional entries (“Bonus Entry Periods”). During the Bonus Entry Periods, Entrants who make a donation at the Website will automatically receive between two (2) and six (6) times as many entries as listed above (exact number of entries based on Bonus Entry Period and donation level). ALL PURCHASES ARE FINAL. THERE WILL BE NO REFUNDS ISSUED DURING OR AFTER THE SWEEPSTAKES PERIOD.

Only one person may be entered in the Sweepstakes per Entry. If the name of more than one person is submitted with an Entry, and that Entry is selected as a winning Entry, then the person named first will be deemed the holder of record of that Entry and declared the potential winner. The Sponsor will not, and is not obligated to, assign the Prize(s) to any person other than the verified Prize winner(s). In the event of a dispute regarding the identity of any Entrant, the authorized account holder of the email address used to enter the Sweepstakes will be deemed to be the Entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider.

All defective or physically altered Entry forms will be immediately disqualified by the Sponsor. Prior to the Prize drawing(s), the Sponsor will make a reasonable effort to notify the individual and/or entity that submits such an Entry form which has been rejected, by attempting to make contact through the information provided at the time of submitting the Entry request. The Sponsor assumes no responsibility for lost, late, or misdirected entries, or any other failure to receive orders or deliver receipts prior to the Sweepstakes deadlines.

Participants must supply truthful and accurate information in regards to the Participant’s name, email address, phone number and street address when requesting an Entry. Failure to supply truthful and accurate information will disqualify a Participant’s Entry. Any attempt by any Participant to obtain more than the stated number of Entries or Entries by using multiple/different email addresses, phone numbers, identities, registrations and logins, or any other methods will void that Participant’s Entries and that Participant will be disqualified.

ADDITIONAL PRIZE CONDITIONS: By accepting the Grand Prize, the Winner agrees to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the Prize. The potential Winner must sign and return to the Administrator, within Five (5) days of the date of notice or attempted notice, an Affidavit of Eligibility, Liability & Publicity (if a USA resident) in order to claim the Prize. The Winner may also be requested to complete an IRS W9 form.  Note: The Affidavit sent to a potential Winner will require that the Winner provide their Social Security Number to the Administrator, which will be used solely for tax reporting purposes. The Winner will be responsible for all local, state, and federal taxes associated with the receipt of the prize. The Winner must note that the value of the accepted Prize is taxable as income and an IRS Form 1099 will be filed in the name of the Winner for the value of the Prize. The Winner is solely responsible for all matters relating to the Prize after it is awarded. If a Prize or Prize notification is returned as unclaimed or undeliverable to the potential winner, if a potential Winner cannot be reached or does not comply with notification instructions within three (5) business days from the first notification attempt, if a potential Winner fails to return requisite document(s) within the specified time period, or if a potential Winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsor’s sole discretion, an alternate Winner may be selected.

By accepting the Prize, where permitted by law, the Winner grants to the Released Parties and those acting pursuant to the authority of Sponsor and the Released Parties (which grant will be confirmed in writing upon Sponsor’s request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time their full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification. The Winner also acknowledges that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Prize. Consult a tax professional. Entrants agree that Sponsor is not providing any accounting, tax or legal advice.

Odds: The odds of winning depend on the number of eligible entries received.

Winner Selection and Notification: Winner will be selected by a secured random drawing under the supervision of Mola Media LLC. Winner will be notified by email and telephone within five (5) days following selection of Winner. Mola Media LLC shall have no liability for Winner's failure to receive notices due to spam, junk email, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within [5 days] from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT Mola Media LLC'S SOLE DISCRETION) WILL RESULT IN WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You understand and agree that Mola Media LLC, anyone acting on behalf of Mola Media LLC, and Mola Media LLC’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent. Optional verbiage for Contests: By entering this content, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Mola Media LLC. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Mola Media LLC from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Mola Media LLC may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

Terms & Conditions: Mola Media LLC reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes for any reason. Mola Media LLC reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond Mola Media LLC’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such a case, Mola Media LLC may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Mola Media LLC. Mola Media LLC reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Terms & Conditions. Mola Media LLC has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, Mola Media LLC reserves the right to seek damages to the fullest extent permitted by law.

DISPUTES: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Entrants, Administrator, and Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Colorado, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s or jurisdiction’s laws.  By participating in the Sweepstakes, Entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, shall be resolved individually without resort to any form of class action; (ii) any judicial proceeding shall take place in a court within the State of Colorado; (iii) any and all claims, judgments , and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event will attorney fees be awarded or recoverable; (iv) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to seek, punitive, incidental, exemplary, consequential, special damages, lost profits, other damages, and/or any rights to have damages multiplied or otherwise increased; and (v) Entrant’s remedies are limited to a claim for money damages (if any) and he/she waives any right to seek injunctive or equitable relief.

Limitation of Liability: By entering, You agree to release and hold harmless Mola Media LLC and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant's participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
